1. Agreement to Terms

By accessing or playing games on Kaverno (https://kaverno.online), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you disagree with any part of these terms, you are prohibited from using the platform. These terms apply to all visitors, users, developers, and other persons who access or use the Service.

2. Description of Service

Kaverno is a web-based gaming platform that hosts and curates free-to-play browser games. Games are provided via WebGL, WebAssembly, and HTML5 technologies from both independently registered developers and authorized third-party game distribution networks. Kaverno earns revenue through advertising displayed alongside game content and shares a portion of ad revenue with registered game developers.

3. Developer Submissions & Licensing

Game developers who upload builds (Unity WebGL, Godot, HTML5, etc.) through the Kaverno Dev Studio warrant that:

• They own all necessary rights, patents, copyrights, trademarks, or licenses to distribute the game.
• The game does not contain malicious code, spyware, cryptocurrency miners, or offensive/prohibited content.
• They grant Kaverno a non-exclusive license to host, display, and stream the game within our web player frame.
• They are solely responsible for the game content they upload and any third-party claims arising from it.

4. Third-Party Game Content

A portion of games available on Kaverno are sourced from authorized third-party distribution networks (such as GameDistribution) that provide embeddable game content under their respective licensing terms. Kaverno displays these games under the terms permitted by these distribution networks. If you are a copyright holder and believe your content is hosted without authorization, please refer to our DMCA takedown procedure below.

5. DMCA & Copyright Infringement Takedown Policy

Kaverno respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA), we respond expeditiously to legitimate notices of alleged copyright infringement.

6. User Conduct & Acceptable Use

Users agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the platform or any hosted games.
• Disrupt or interfere with platform infrastructure, servers, or connected networks.
• Deploy automated scraping bots, crawlers, or data harvesting tools without express written permission.
• Exploit game mechanics or vulnerabilities to harm other players or manipulate leaderboards.
• Attempt unauthorized access to developer studios, admin portals, or other user accounts.
• Use the platform to distribute spam, malware, phishing schemes, or illegal content.
• Interfere with or circumvent the advertising systems displayed on the platform.

7. Advertising & Monetization

Kaverno displays advertisements through Google AdSense and other advertising partners. By using this platform, you acknowledge that advertisements will be shown alongside game content. You agree not to engage in invalid click activity, ad fraud, or any behavior intended to artificially inflate advertising metrics. Violation of this policy may result in immediate account termination.

You agree to defend, indemnify, and hold harmless Kaverno and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit or publish on the platform.

Kaverno is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We make no warranties regarding uptime, gameplay compatibility across all hardware or browsers, developer earnings accuracy, or the safety and quality of third-party game code executed within the browser sandbox.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kaverno operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
